The facts are in a case again. The verdict was for the homeowner. The homeowner was required to pay the amount of the decrease in value of the home. She decided not to appeal the verdict.Â .
Interesting question – why did the defendant choose not to appeal?
Let us look at the question “In what sense did the defendant choose not to appeal?”
The defendant was found to have engaged in misleading advertising.
In this case, the fact that the defendant was found to have engaged in misleading advertising would be an independent ground for appeal. It does not depend on the increase in value of the plaintiff’s home.
The plaintiff’s home was valued at (the fair market value).
The defendant’s house was valued at (the fair market value).
The plaintiff’s house was worth (the fair market value).
The defendant’s house was worth (the fair market value).
In the case where the defendant’s house is valued at (the fair market value), it is obvious that an appeal was required. The defendant did not want to pay a discount to get the house to a lower value and then have that lower value come back after the appeal. The defendant must have known the case would come back on the unfairness of the ads, and so an appeal would not have been in its interests.
Similarly in the other two cases, and with only one mistake, an appeal would be required, and so presumably if the defendant did not want to take up its right to appeal, it must have made a reasoned judgement that an appeal was not worthwhile.
